By creating an account or using BidPainter ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. BidPainter is operated by 120 Dreams LLC ("we", "us"). You must be at least 18 years old and authorized to bind your business to these Terms.
BidPainter is a software-as-a-service tool that helps painting contractors create estimates, generate shareable estimate links, collect customer signatures, send PDFs, and collect deposits from customers via Stripe. Features available depend on your subscription tier.
You are responsible for the accuracy of the information you provide, for maintaining the confidentiality of your credentials, and for all activity under your account. Notify us at hello@120dreams.com of any unauthorized use.
You agree to use BidPainter only for lawful purposes related to your painting business. You will not (a) misrepresent your identity or your business, (b) use the Service to send spam or unsolicited communications, (c) attempt to reverse engineer, scrape, or interfere with the Service, or (d) upload content that infringes anyone's rights or that you do not have permission to share.
You retain ownership of the customer and estimate data you submit ("Your Data"). You grant us a limited, worldwide license to host, process, transmit, and display Your Data solely to provide and improve the Service. You are responsible for obtaining any consent required from your customers before uploading their information.
Paid plans (Pro, Crew) bill in advance on a recurring monthly or annual basis through Stripe. Subscriptions automatically renew until canceled. You authorize us to charge your payment method for the applicable fees plus any taxes. Prices and plan features may change with at least 30 days' notice for existing subscribers.
BidPainter lets Pro and Crew users collect deposits from their customers via Stripe Checkout. Deposit funds are paid by the customer to you (the painting contractor) through Stripe — we do not hold customer funds. You are solely responsible for fulfilling work, issuing refunds, and complying with all laws applicable to deposits, including contract and consumer protection laws in your jurisdiction.
You may cancel your subscription at any time from Settings. Your access continues through the end of the current billing period. We do not provide refunds for the current billing period or for unused time. Annual plans canceled mid-term are not pro-rated. Deposit transactions between you and your customers are subject to your own refund policy and Stripe's processing terms.
To the maximum extent permitted by law, BidPainter and 120 Dreams LLC are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months preceding the claim. The Service is provided "AS IS" without warranties of any kind, express or implied.
You agree to indemnify and hold harmless 120 Dreams LLC, its officers, and employees from any claim arising from Your Data, your use of the Service, or your violation of these Terms.
We may suspend or terminate your account at any time for violation of these Terms or for unlawful use of the Service. You may close your account from Settings; we will delete or anonymize Your Data within a reasonable period after closure unless retention is required by law.
We may update these Terms from time to time. Material changes will be communicated by email or in-app notice. Continued use of the Service after the effective date constitutes acceptance.
These Terms are governed by the laws of the State of Illinois, United States, without regard to conflict-of-law principles. Any dispute will be brought exclusively in the state or federal courts located in Cook County, Illinois, and you consent to the jurisdiction of those courts.
